If you have any outstanding repairs or think that you may have damp or mould in your home, it’s important that you talk to us as soon as possible. As your landlord, we will carry out any repairs and undertake surveys to ensure that there are no outstanding issues in your home.

We have seen an increase in the number of residents submitting disrepair claims against Regenda. While you’re well within your rights to do this, we wanted to let you know what happens when you instruct a claims management company. We would always recommend that you speak to us before making a claim, as we will always carry out any repairs needed.

Who are claims management companies?

Claim management companies will act on your behalf to make a claim against Regenda for poor housing conditions. You will sign a legally binding agreement and may be asked to appear in court to give evidence. Some companies operate on a ‘no win no fee’ basis, and will take solicitor and legal fees out of any potential compensation you receive. Others will charge you a fee to act on your behalf. It’s important that you read any agreement carefully.

I have signed an agreement – what happens now?

The claims management company will instruct a solicitor to act on your behalf, and they will contact Regenda to begin the process. Some claims can take years to resolve, and you may have to appear in court to give evidence as part of the process. We will robustly defend any cases that we believe are not legitimate. You may be asked to breach your tenancy agreement by not allowing access for repairs to be carried out. If access is not granted, we will seek legal action to gain entry to your home to carry out repairs and will pass the cost of this back to you.

 

I have signed an agreement but have changed my mind – what can I do?

When you have signed an agreement up and put forward a claim from a solicitor, you may be charged a fee to withdraw your claim. If you have started a claim and have changed your mind, please call us on 0344 736 0066 as we may be able to help.

What are the risks of making a claim?

Your finances can be adversely affected when you submit a claim – some companies ask you to pay a fee up front and you may be liable for any court fees. It’s important to read the small print of any agreement to ensure you understand the risks.

Alternatives to making a disrepair claim

If you are not satisfied with the condition of your home, there are a number of options available that do not present a risk to you or your finances. These include:

• Making a formal complaint, which will be dealt with through our complaints process

• If you are still dissatisfied, you can escalate your complaint to the Housing Ombudsman

Any repairs required will always be carried out and you may be entitled to compensation.
